Frequently asked questions
Who qualifies for the no tax on tips deduction?
Employees and self-employed workers in an occupation on the Treasury list of jobs that customarily and regularly received tips on or before December 31, 2024. You need a valid Social Security number, and married couples must file a joint return.
What counts as a qualified tip?
Voluntary cash or card tips, including your share of a tip pool, that are reported on Form W-2, Form 1099 or Form 4137. Mandatory service charges, such as an automatic 18% for large parties, are not tips unless the customer can remove or change them.
Do I still pay Social Security and Medicare tax on tips?
Yes. The deduction lowers federal income tax only. Social Security and Medicare (7.65% for employees) still apply, and state income tax depends on your state.
Is there an income limit?
The deduction drops by $100 for every full $1,000 of modified AGI above $150,000 ($300,000 for joint filers). A $25,000 deduction is gone at $400,000 ($550,000 joint).
Do I need to itemize?
No. You claim it on Schedule 1-A and it is allowed on top of the standard deduction. It is available for tax years 2025, 2026, 2027 and 2028.
